Action Requested:
The Northfield City Council approves a Construction Agreement with Canadian Pacific Kansas City (CPKC) Railroad.

Summary Report:
The agreement brought forth between the City of Northfield and CPKC which provides the City access rail road right-of-way in order to complete the improvements associated with the Lincoln Waterway Box Culvert Improvement Project. City Council approved the plans via resolution 2024-015 at the February 20th Council meeting. The project scope is to replace the existing 2-foot by 3-foot box culvert which lies underneath the railroad line and replace it with the proposed 6-foot by 8-fot box culvert.

City staff have coordinated with Progressive Railroad Inc., who operates on the CPKC railroad line, to ensure all agreements and permits are in place or will be applied for after the project is awarded and prior to construction since they are also a permit authority with this project.

The agreement also defines long term ownership and maintenance responsibilities following agreement execution and successful project implementation. CPKC will own and maintain the proposed box culvert from this point forward. The City will reimburse CPKC for maintenance conducted on the box culvert throughout its useful life and will be responsible to future replacement cost.

The proposed improvement provides long-term flood mitigation, as well as it benefits the health and safety of many residents adjacent to the Lincoln Waterway, which was identified during the 2020 Surface Water Model Update.
