Consider Motion to Amend Ordinance 1006.

Action Requested:
The Northfield City Council is requested to consider a motion directing staff to present a revised Ordinance 1006 (attachment 1) on Signage in the Downtown Historic District for the July 23, 2019 City Council meeting.

Summary Report:
On June 18, 2019, City Council passed on First Reading Ordinance 1006 revising signage regulations in the Downtown Historic District. An inconsistency between the staff report and the Ordinance was noted when preparing the Ordinance for Second Reading. Staff is requesting City Council move to approve the corrected version of the Ordinance. If this motion passes, the corrected Ordinance will be posted on the City of Northfield webpage to meet statutory requirements so the Ordinance can be passed on Second Reading on July 23. The request for summary publication will also occur on July 23.

The issue is that the Heritage Preservation Commission recommended new language allowing the HPC the authority to require existing signage be brought into compliance with current regulations when new signage is proposed. The Planning Commission viewed the amendment and recommended it not be added to the Ordinance. Staff concurred with removing this language, and it should have been removed in the Ordinance presented to Council on June 18th. The language to be stricken is shown below:

The Planning Commission made a few minor wording changes to the Ordinance and removed a clause granting retroactive powers:

The Historic Preservation Commission reserves the right to require existing non-complying signage to be brought into compliance upon receipt of any application to the Historic Preservation Commission.

After a unanimous vote, the Planning Commission forwarded to City Council a recommendation of approval.
