Body

Action Requested:

The Northfield City Council approves a 3.2 off-sale liquor license for Holiday Stationstore, LLC - 100 Water Str., Northfield effective until March 31, 2018.

Summary Report:

Holiday Stationstore, LLC has applied for an off-sale 3.2 liquor license for 100 Water Str., Northfield.  This location is currently licensed as Holiday Stationstore, Inc. with an off-sale 3.2 liquor license.  Holiday Stationstores, Inc. is going through a change in membership interest and conversion from a Minnesota Corporation to a Minnesota Limited Liability Company.  On or about December 15, 2017, Holiday Companies, the parent company of Holiday, is under contract to transfer its membership interest in Holiday.  Upon closing, the licensee will continue to be Holiday Stationstores, LLC with the only change to the licensee being a complete change of officers effective upon the Closing.  The local managers remain the same at this location.  Liquor licenses are not transferrable.  The Department of Public Safety Alcohol & Gambling Enforcement Division requires a new license for this change.  No public hearing is required for this location since the premises is currently licensed.  The application for liquor license has been checked for compliance, which covers the provisions of Minnesota State Law and City Code.

Financial Impacts:

The City received $150 for this license. Normal fees are $510.00.  The Liquor license fee is one-half the normal amount per City Code 6-62 (c) since 8 months of the license year have elapsed. Since this is an existing licensee with a name change only and retaining the local managers, the background fee and tax certification fee are waived.  Renewal of this license with the full fee will be required with all other liquor licenses during the first quarter of 2018.

Tentative Timelines:

If approved, the license will be forwarded to the Department of Public Safety Alcohol & Gambling Enforcement Division for approval.  The approval needs to take place before the proposed closing date of December 15, 2017.
