Consider Accepting Easements for Lot 1 Block 5, and Lots 1-5 Block 4 East Woodley Addition Blocks 3-5, 13, 20, and 21.

Action Requested:                     

The Northfield City Council approves Accepting Easements for Lot 1 Block 5, and Lots 1-5 Block 4 East Woodley Addition Blocks 3-5, 13, 20, 21.

 

Summary Report:

During the initial stages of the Woodley Street Apartments development project, it was brought to the City’s attention that the existing City owned sanitary sewer main was not located within the dedicated easement as originally platted (Attachment 1).  It was also discovered that a garage encroached into the existing easement on Lot 5 Block 4.  Therefore, a relocation of the existing City owned sanitary sewer main and watermain on Lot 1 Block 5 and Lot 5 Block 4 is planned.  Prior to the relocation of these City owned utilities, new easements must be dedicated and accepted by City Council and recorded with Rice County. 

 

Alternative Options:

The City Council could decide not accept these easements, however, the relocation project cannot be performed, and therefore the proposed development cannot be completed as planned.    Additionally, the City would not have legal access to these City owned utilities that are currently located outside of the dedicated easement, should the need arise. 

 

Financial Impacts:                     

A total of five easements (Attachment 2) are required for the easement.  Each easement will be acquired for the sum of One Dollar ($1.00).  Therefore, there would be a total cost of $5.00 for the executed easements.
