Consideration of a Stormwater Maintenance Agreement with DIVOCSG 17 LLC.

Action Requested:                     

The Northfield City Council approves a Motion authorizing the City to enter into a required Maintenance Agreement and Maintenance Plan with DIVOCSG 17 LLC for private stormwater management facilities for the DIVOCSG 17 LLC Community Solar Garden.

 

Summary Report:

DIVOCSG 17 LLC is constructing a new one-Megawatt community solar garden. As part of the project to meet stormwater management requirements, private on-site stormwater facilities are proposed for construction to collect, convey, and treat stormwater runoff. 

 

According to Northfield City Code, Chapter 22 - Environment, stormwater treatment is required to treat the additional stormwater generated from the added impervious surface on the site.  William R. Cole, Managing Member of DIVOCSG 17 LLC, approved the agreement on November 25, 2024, and is ready for the City to execute the agreement.

 

The City of Northfield Ordinance Section 22-306 requires the execution of a Maintenance Agreement (Attachment 1) with the City of Northfield to ensure proper inspections and maintenance are performed on the proposed stormwater management facility.  This agreement also grants the City of Northfield and its representatives’ right of entry for the purpose of inspecting the proposed stormwater management facility, and performing any maintenance on the stormwater management facility should the owner fail to perform the required maintenance detailed in the Maintenance Agreement.  

 

Financial Impacts:                     

There are no financial obligations for the City of Northfield with this agreement.
