Action Requested:

The City Council is asked to consider the second reading of Ordinance No. 1083 amending Chapter 30 - Health and Sanitation of the City Code Regarding Regulation of Cannabis Businesses, Lower-Potency Hemp, Edible Retailers and Events.  The first reading of this ordinance was approved at the August 19, 2025 Council meeting.

 

Summary Report:

This ordinance amendment aligns City Code with recent changes in state law, specifically updating terminology from “preapproval” to “preliminary license approval.” Additional revisions clarify the City’s registration requirements, required timing for registration and inspection, and mandate that a copy of the license be submitted to the City prior to the commencement of cannabis retail operations. A redlined version of the proposed changes is included as Attachment 1.

 

Alternative Options:

No alternative options are recommended. The proposed updates are intended to bring the City Code into compliance with current statutory language and regulations established by the Minnesota Office of Cannabis Management and clarify current City Code provisions regarding registration limitations.
