Action Requested:
The Northfield City Council approves a motion to Consider Third Amendment to Declaration of Protective Covenants & Easements for Vermillion River Crossings.

Summary Report:
As owners of the Northfield Hospital + Clinic location at 4645 Knutsen Drive in Farmington, Minnesota, the City of Northfield is being asked to approve the 3rd amendment to the existing Declaration that clarifies that a residential development is permitted on the property subject to the Declaration. Per Hy-Vee's request, it also relinquishes the restrictive covenant prohibiting financial institutions on any lot except the lot owned by Hy-Vee located at 4665 Knutsen Drive, Farmington, MN. The residential restriction and the financial institution are not necessary and the amendment deletes them entirely.

Also attached is the original Declaration and the prior amendments. The developer needs the owners of 75% of the land area subject to the declaration to sign off on the amendment. With Hy-Vee, Northfield, and Aldi, that requirement would be satisfied.

The developer is planning to develop a Class A Apartment project, 168 units. The City of Farmington has given us full approval of the project, plus HyVee is supportive. The plan is scheduled to close around end of July and start the project in August.

Jerry Ehn, Northfield Hospital and Clinics Vice President and Chief Operating Officer supports and requests City Council approval. The request has come in prior to the NH+C Board meeting so they have not reviewed. The added housing and residents near the clinic are a positive benefit to the clinic.
