Action Requested:
The Northfield City Council consider a motion to approve an Amendment to the Indefeasible Right of Use Agreement, dated June 8, 2021 is entered into between CMN-RUS, LLC (f/k/a CMN-RUS, Inc.) and its affiliates (collectively, "Metronet"), and the City of Northfield, Minnesota.

Summary Report:
The City of Northfield staff recommends that the Northfield City Council consider a motion to approve an Amendment to the Indefeasible Right of Use Agreement with CMN-RUS, LLC. (Metronet) to maintain the monthly maintenance fee of $88.89/month on dark fiber connections.

This proposed Agreement includes 24 connections and would expire on August 4, 2036. It takes into consideration the movement of a dark fiber connection from the existing Arena to the new location at 1900 Cannon Road, and movement of a connection from the former Northfield News building to the new Transit Hub at 203 2nd St. W. The monthly maintenance fee included in the agreement provides savings to the City verses the anticipated cost based on conversation with Metronet and verses competitors that may also not provide service to the same City locations. A more detailed breakdown is below under Financial Impacts. This agreement was negotiated by City staff in partnership with legal counsel specializing in telecommunication law.

Continue current Indefeasible Right of Use Agreement and not approve the Amendment.
