Resolution Waiving the 60-Day Recording Requirement Condition of the Final Plat Approval for Cedar Meadows and Ratifying Replacement Development Agreement

The City Council of Northfield, MN is asked to approve a resolution waiving the 60-day recording requirement condition of the Final Plat for Cedar Meadows and ratifying the Replacement Development Agreement.
Summary Report:
At the July 9, 2024 City Council meeting Council approved Resolution 2024-076 approving the original Development Agreement for Cedar Meadows and Resolution 2024-075 approving the Final Plat for Cedar Meadows. As a condition of that Original Development Agreement the developer was required to record the Final Plat within 60 days. Due to unavoidable delays occurring after the original approval of the Resolutions associated with the Developer obtaining financing for the project, the Developer did not record the Final Plat or the Original Development Agreement as required. The Developer continued to work to secure the required financing and enter into a new Development Agreement correcting the project timing issues. Ultimately, a new Replacement Development Agreement was drafted and executed on March 2, 2026 and recorded as Document No. 3721228 (the “Replacement Development Agreement”), which amended and updated the timing for commencement, completion, and recording of the project.
City staff proceeded with the execution of the Replacement Development Agreement without further action from the Council to correct the timing issues in the Original Development Agreement. The Original Resolution allowed staff to make minor or technical changes, and staff concluded that no changes altered the approved Final Plat nor the Project.
