Consideration of Variance Request for Cardinal Glass at 1500 Industrial Dr.

Action Requested:
The Zoning Board of Appeals will consider a variance to encroach 10 feet into the 20-foot front yard setback for 1500 Industrial Dr.

Summary Report:
1500 Industrial Dr. is zoned Industrial (I1-B) and is located at the intersection of Industrial Dr. and Armstrong Rd.

The applicant, Cardinal Glass Industries, requests a variance to encroach ten (10) feet into the front yard setback to construct an addition at 1500 Industrial Dr. The land development code (LDC) has a twenty (20)-foot front yard setback for the I1-B Zoning District.

The criteria for approving a variance, according to Section 5.5.16(C), are as follows:
(1) Pursuant to Minn. Stat. ?462.357, Subd 6, as it may be amended from time to time, the zoning board of appeals may only grant applications for variances where practical difficulties in complying with this LDC (Land Development Code) exist and each of the following criteria is satisfied:
(a) The variance is in harmony with the general purposes and intent of this LDC; and,
(b) The variance is consistent with the Comprehensive Plan; and
(c) The property owner proposes to use the property in a reasonable manner not permitted by this LDC; and
(d) The plight of the landowner is due to circumstances unique to the property not created by the landowner; and
(e) The variance, if granted, will not alter the essential character of the locality.

Findings for each of the criteria are included in the attached draft resolution.

Staff Recommendation:
Staff supports the variance request to allow a ten (10)-foot encroachment into the twenty (20)-foot front setback.

Alternative Options:
1. The ZBA could deny the resolution,
2. The ZBA could approve a modified resolution.
