Title
Consideration of a Resolution to Recommend Park Dedication Fees for Future Text Amendment

Action Requested:
The Planning Commission is asked to review and recommend the proposed text amendment related to Park Dedication Fees.

Summary Report:
The City Attorney is reviewing the relevant text of the LDC with regards to the direction and intent from the PC, Staff, and Council and developing a defensible policy. There has been several relevant legal cases since the existing policy was adopted. Staff anticipate providing a draft-redline by supplemental memo.

Background
In December 2025, staff brought forward a proposed text amendment to introduce a fee to the park dedication provisions in the Land Development Code (LDC). The premise of that proposal was based, in part, on the understanding that Northfield’s park dedication fees were lower than many comparable cities. The recommendation from staff was based on bringing the fees in line with other communities.

The Planning Commission (PC) raised several concerns summarized as:
Equity and affordability of housing
Cost of development
Long-term maintenance of parks
Ease of administration

At the September 17, 2026 PC meeting, the PC provided additional direction that certain policy considerations, including the how to fund park improvements, and the amount necessary to provide those improvements were the purview of City Council. The general direction was that the fee should be moved to the council-approved fee schedule, and that updating it annually to reflect changes to the cost of construction and other conditions was appropriate.
