Discussion of the Land Development Code and Certificate of Appropriateness.

None.  Update and discussion included.

 

Summary Report:

City Administrator Martig requested to be on the agenda related to the current questions of the Certificate of Appropriateness.  The background and reference to the interpretation is attached with the staff memo.  Staff has been exploring this issue and is planning to address any confusion of language through ordinance amendment to be made by the City Council.  Staff intends to include the HPC in review of ordinance options prior to City Council action.  See the tentative timelines for more information.

 

Staff supports concurrently providing formal input related to the conceptual design phase ongoing review of Bridge Square. 

 

Heritage Preservation Commission Subcommittee on Bridge Square

The Heritage Preservation Commission (HPC) subcommittee has drafted the attached “draft” memo to City Council. They had requested this to be included as a separate agenda item from Bridge Square.  Since it relates to the City Administrator’s agenda item it was included.

 

The timeline provides the opportunity for the input from the HPC.  Should there be need for further clarity of process or review details that would be something to consider after the ordinance is amended.

 

Next Steps

Staff will be proceeding with this review on the current timeline below.  Should the Commission want to consider some action there are some alternatives listed in the staff report below.

 

Alternative Options:

A.                     The Commission consider a motion to approve the draft March 10th unedited version of the draft subcommittee memo.

Staff is not recommending this option as it would not be appropriate for the City Council to provide interpretation and clarity of the COA provision as that is a staff role.  However, the alternative to consider an ordinance to provide clarity would be appropriate.

B.                     The Commission consider a motion to approve the draft March 10th edited version of the draft subcommittee memo.

Staff amended language related to Council interpretation of existing code.  Alternatively, the memo is proposed to be amended to reflect an ordinance amendment to clarify the language.  The remainder of the background was left as presented.

 

C.                     Some modification of “A” or “B” following more broad discussion by the HPC.

o                     April 5th - Update to Council on Review of Certificate of Appropriateness

o                     April 12th - Council Work Session Discuss Certificate of Appropriateness Status and Ordinance Considerations

o                     April 14th - HPC review ordinance amendments and discussion related to Certificate of Appropriateness

o                     Date to be determined - Planning Commission holds a public hearing & makes a recommendation to Council

o                     April 19th - Council review and discussion on Ordinance related to Certificate of Appropriateness

o                     April 19th or after to be determined - First and Second Readings of Ordinances
