Title

Consider Resolution Extending Mayoral Proclamation Declaring a Local Emergency.

Body

Action Requested:

The Northfield City Council consider Resolution Extending Mayoral Proclamation Declaring a Local Emergency.

Summary Report:

The Northfield City Council is being asked to extend the declared emergency disaster declaration for the ongoing flood event.  Mayor Pownell signed a proclamation declaring a state of emergency on June 24, 2024.

The benefit for the emergency declaration is to authorize emergency agreements and contracts that public safety and public works may need for mitigation and cleanup efforts.  The Police Chief has requested assistance from the Army Corps of Engineers as noted on the other agenda item scheduled for the emergency meeting that provides additional state resources but requires a local emergency declaration to qualify.

Also, the Governor has made a State emergency disaster declaration so City and potentially private property owners could qualify for additional state or federal resources.

Per our City Attorney, below is the basic process and responsibilities for declaring an emergency includes the Mayor declaring the emergency.  The City Council may extend the declaration after three days. The City Council may also rescind any such regulation at any time Under Statute, the Mayor must declare an emergency.  The city council may rescind any such regulation by resolution at any time.  If not sooner rescinded, every such regulation shall expire at the end of 30 days after its effective date or at the end of the emergency to which it relates, whichever occurs first.

Attached is the resolution (attachment 1), a signed copy of the emergency declaration (attachment 2), links to Minnesota State Statues 12.29 and 12.37 (attachment 3 and 4), and City Charter/City Code related to local emergencies (attachment 5).

Police Chief Elliott will be providing a presentation of the emergency response to the event and ongoing work anticipated through the emergency declaration. Additionally, there will be some information on past flood management efforts and exploration of additional flood mitigation the City has been exploring.
